Terms of Service

These terms govern your purchase of websites, automation systems, and related services from Vinsetta Studio LLC ("Vinsetta Studio," "we," "us") through vinsettastudio.com. By purchasing, you agree to these terms. If you're buying on behalf of a business, you confirm you're authorized to do so.

What you're buying

We offer a website two ways. One-time purchase: a custom website built for your business, delivered as a complete set of source files (HTML, CSS, JavaScript, images, and a setup guide). Each purchase is for one website. If you choose the free "install it for me" option at checkout, we'll also publish the site to a hosting location you provide, as a courtesy — hosting, domain registration, and any third-party service fees are your responsibility. Or a monthly Hosted + Care Plan: we host, maintain, and update the site for you — see the Hosted + Care Plan section below.

Payment

Prices are shown at checkout in U.S. dollars and are charged as a one-time payment unless stated otherwise. Payments are processed by Stripe; by paying you also agree to Stripe's terms. You're responsible for any applicable taxes not collected at checkout.

Delivery

Your website files are delivered immediately after a successful payment, by a download link sent to your email and shown on the confirmation page. If you chose the install option, we'll reach out to arrange publishing after purchase.

Refunds

Because your website files are delivered to you immediately upon purchase, all sales are final and payments are non-refundable. If something isn't right, contact us within 7 days of purchase and we'll work to make it right.

Hosted + Care Plan (monthly subscription)

The Hosted + Care Plan is a month-to-month subscription. We publish the website to hosting we control, keep it online, and maintain it for you. It includes:

  • Hosting & upkeep — hosting, SSL, backups, security updates, and uptime monitoring.
  • Minor content updates — up to two update requests per month, totaling about one hour of work. Covered examples: text, price, or hours changes; swapping a promotional banner or coupon block; adding a news or announcement item; photo swaps; holiday hours; small service-list changes. You provide the words and images. Unused requests don't roll over to the next month.
  • Quarterly health report — a written accessibility and speed re-check every quarter.
  • Google Business Profile management — categories, service areas, posts, photos, questions, and drafted review responses.
  • Service pages, written and then kept current — your money services are researched and written as part of the build, with copy included. After that they are maintained rather than rewritten: price changes, seasonal work, a new service, and new questions customers are asking. You review anything before it publishes. Substantial new pages beyond the build are quoted separately.
  • A monthly report — what was done, what moved, and what did not, with positions measured from a fixed reference point rather than from your own device.

Not included (quoted separately as new work): additional pages beyond the one included each month, layout or design changes, new features (such as booking, e-commerce, or new forms), logo or brand design, photography, third-party integrations, any management of paid advertising, and any request beyond the monthly allowance. Update requests are typically completed within 2–3 business days. If the site itself is down, that's on us — it's a hosting issue, always covered, and never counts against your allowance.

What we do not promise: no specific ranking, position, traffic level, call volume, or revenue figure is guaranteed, because none of those is under our control. What is guaranteed is that the work listed above is performed each month and reported honestly, including when it produces no measurable change.

Files and ownership on the plan: while you're subscribed, the website files remain the property of Vinsetta Studio LLC — the plan buys hosting and service, not the files. You may purchase the files outright at the standard one-time price at any time, and from then on the one-time purchase terms apply. Your domain name is always yours: we recommend it be registered in your name, and we'll point it at the site for you.

Cancellation: on the standard monthly rate, cancel anytime through the payment portal linked from your Stripe receipt, or by emailing us. Cancellation takes effect at the end of the paid month; the current month isn't refunded or prorated. If payment fails or the plan is cancelled, the hosted site is taken offline after a 14-day grace period. Your domain stays yours and unaffected.

Founding-client rate: the discounted founding rate is offered to the first three clients only and is a twelve-month commitment, which is what pays for a website built with no fee and no deposit up front. The first 30 days are free; the twelve-month term begins after them. It is not month-to-month, and the sentence above about cancelling anytime does not apply to it. In exchange for the rate, the client agrees to provide a testimonial and to allow us to publish the results of the work. There is no penalty beyond completing the twelve months. After the term ends the plan continues month-to-month at the rate then published, and either side may stop it.

Ownership & license

Once your payment clears in full, you own the website files we deliver and may use, modify, and host them for your business. Some components are provided under third-party licenses that stay with their owners — for example, open-source fonts (under their respective open-font licenses) and any stock or licensed imagery, which you must use within those licenses. We may show your finished site in our portfolio and marketing unless you ask us in writing not to.

Your responsibilities

  • Give us accurate business information, and only content (text, images, logos) you have the right to use.
  • Review the delivered site and report any issue within 7 days.
  • Maintain your own hosting, domain, and any third-party accounts the site relies on after delivery.

No warranty

We build to a high standard, but the website is provided "as is." We don't warrant that it will be uninterrupted or error-free, or that it will achieve any particular business result. Any maintenance, updates, or new work after delivery is a separate arrangement.

Limitation of liability

To the fullest extent permitted by law, Vinsetta Studio's total liability for any claim relating to a purchase is limited to the amount you paid for it. We are not liable for indirect, incidental, or consequential damages.

Governing law

These terms are governed by the laws of the State of Michigan, without regard to its conflict-of-laws rules. Any dispute will be handled in the state or federal courts located in Oakland County, Michigan.

Changes

We may update these terms. The version in effect at the time of your purchase applies to that purchase. When we revise them, we'll update the date at the top of this page.
